FAQ: “Do we have to sell our home before we can get divorced?” or “Do we have to wait to sell our home until after the divorce is over?”
ANSWER: No, to both questions. Both of these questions are common myths that cause people to wait to start a divorce. It typically is not necessary to sell, or wait to sell, a marital home before starting or even finalizing a divorce. It is important only that you agree on what is going to happen to the marital home and that those details be included in the Settlement Agreement and/or Judgment of Divorce, regardless of whether the sale is before, during, or after your divorce. This is true of almost any marital asset or debt.
