Q. Can I change my name in the divorce?

A. Unfortunately, the answer depends on whether you are male or female.

Clients are surprised to learn that the statutory ability to change one’s name in a divorce judgment is granted only to women. Under the laws of the State of Michigan, in a Judgment of Divorce, a woman has the right to choose to change her surname back to her maiden name or adopt an entirely new surname.  MCL 552.391. No similar right is granted for men – and, for a couple who adopts a new or hyphenated last name when they married – this is plainly an unfair result.
